Only Truth Will Liberate Abia, Not These Absurd Comedies by... Ubani Monday Onyekachi

Today the 4th of July, 2016 the application for stay of execution filed by Dr Okezie Ikpeazu came up for hearing by the very judge that ordered Dr Ikpeazu to vacate the governor's seat, that is Justice Okon Abang. Note that there was no stay ever granted by any court and that this is the first time the motion for stay is coming up for argument which is in tandem to what I have been saying in all the media houses(print and electronic) that appeal does not operate as a stay; the appellant still has to bring a motion for stay and argue it successfully. It is not granted as of right, but an exercise in discretion of the judge which he exercises judicially and judiciously after considering meticulously facts placed before it. Therefore the motion for stay which was filed and served last Wednesday on Dr Ogah's team was responded to through a counter affidavit which was also served on Dr Ikpeazu's team. When the matter came up today, the legal team of Dr Ikpeazu requested for an adjournment in order for them to file a reply to the counter affidavit of Dr Ogah's team. 
Thereafter Dr Ogah's team drew the attention of the learned judge to the order of injunction granted at Osisioma Ngwa high court to which they requested for it to be vacated, the legal team of Dr Ikpeazu replied that it was the Ogah!s team that engaged in self help in securing swiftly the certificate of return from INEC .The learned judge intervened and adjourned the matter to the 7th of July where these applications ( oral and written) will be heard and rulings made thereon.

It is therefore shocking, nauseating and clearly an imagination of a comedian for some people to post that Justice Abang said that the Enrollment Order obtained and served on INEC was unenforceable. You ask yourself what is the meaning of such a ruling, what would have warranted it if at all it was said? There was no such ruling or statement ever made by the learned judge. No judge will say that his judgement is unenforceable. It is just pure propaganda, tissues of issues and creation of comfort for a sinking ship. Sad!

As long as the judge has not made any statement contrary to his judgement of 27th June, 2016 the inference and conclusion is that his judgement of that date still stands, the certificate of return of INEC is in order and the illegal order of Ngwa High court subsists until vacated legally! Any other interpretation will be absurd, lies and dead on arrival.

The second issue that caught my attention was the press conference of some elders from Abia State who described the judgement of Justice Abang as absurd, illegal and travesty of justice. What is laughable is that the group consist of men like T.A. Orji, Onyeama Ugochukwu etc. Follow me to laugh or is it to cry for my beloved Abia. I heard them loud and clear sitting on appeal over Justice Abang's judgement and they mercilessly upturned his judgement without the benefit of going through the judgement(or record of proceedings) as lawyers will say. Once again follow me enjoy the comedy playing out in my beloved Abia.

The third and the last for today was the report that the Head of the Board of Internal Revenue in Abia issued a statement authenticating Dr Ikpeazu's tax papers which the court of Justice Abang had impugned in his judgement of last Monday. 
Was he doing this voluntarily? Can he swear to God Almighty that created his parents and him that he deducted tax of Dr Ikpeazu at source? Can he face God to tell these lies he is spewing out now after the court has passed its verdict? Pray of what use is this after-thought testimony and belated authentication after the verdict of court? For the fact that he is now saying that the documents are genuine will it turn all those falsification suddenly into genuine documents? Again follow me make we laugh together. Every Tom, Dick and Harry in Abia State today knows that Dr Ikpeazu did not pay his three years tax he submitted to INEC as and when due. Where there is honour he would have come out, apologize to Abians and Nigerians and seek general forgiveness, but instead of doing that, he is still fighting back with state resources on a weak moral and spiritual ground. No tax was paid, he knows it, Abians know it and finally God knows it! Truth will prevail 
at the end.
